Article 2 - Applicability of these terms and conditions
1. These terms and conditions shall apply to any agreement between Mystic Collectibles and the consumer, no matter what means of communication is used.
2. The acceptance of an offer or placing an order implies that you agree to the aforementioned conditions.
Article 3 - Registration
1. By registration of an account you need to fill in the requested information truthfully.
After registration you will have access to your personal page where you can customize and modify your data.
Without registration and login, you cannot order.
2. Users under the age of eighteen (18) years must have permission from parents or a guardian to create an account.
By accepting these terms, you warrant that you are eighteen (18) years or older or have the permission of your parents or guardian.
3. You are solely responsible for the use of your account, even if others use your account, either with or without your permission.
This means that you are solely responsible for maintaining the confidentiality of your account password.
4. You have to give us, and on the website, exact and accurate information and you are held to keep this information up to date and inform us of any changes.
Article 4 - Compliance
1. Mystic Collectibles guarantees that the goods meet the specifications stated in the offer, the reasonable requirements of reliability and/or usability and do not conflict with on the date of the conclusion of the agreement existing legal provisions and/or Government regulations.
2. If the delivery address of the consumer is in a different country than the one where Mystic Collectibles is located, it is the responsibility of the consumer to verify that the goods delivered are conform to the existing legal provisions and/or Government regulations in his or her country.
Article 5 - The offers and prices
1. The offered goods are as clear and truthful as possible depicted and/or described.
If there is a limited period of validity of the offer, this constraint will be clearly stated.
2. Mystic Collectibles aims for a site with accurate and updated information.
Illustrations, photos, figures, colours, charts and technical specifications on this site are not binding.
Mystic Collectibles does not guarantee the accuracy or clarity of the information provided on the site.
3. Mystic Collectibles reserves the right to change prices without giving prior notification.
Likewise Mystic Collectibles retains the right to modify or improve the information on this site without prior notice when we deem appropriate.
4. The displayed price in the (online) catalog of Mystic Collectibles is exclusive of shipping costs, except is case of errors and typos.
Mystic Collectibles reserves the right to correct any errors in the prices and to calculate the correct price.
Under these conditions, we will contact you to inform you.
5. After the conclusion of the agreement there will be no price increases to take place unless the price increase is the result of legislation or regulations or that there are as set out in article 5.4 there is a typing error or correction.
Article 6 - Conclusion of the contract
1. The agreement will be concluded at the moment of acceptance of the order by Mystic Collectibles and meeting the corresponding conditions.
2. Mystic Collectibles is entitled to refuse orders and/or attach any conditions to the delivery.
3. When an order is denied Mystic Collectibles will report it to you within 7 days after receipt of the order.
7. If due to a technical error an ordered item turns out to be out of stock, Mystic Collectibles will inform the consumer as soon as possible.
8. After placement on the website, if you discover that you made a mistake with your order, please contact by e-mail: info@mysticcollectibles.com.
Article 7 - The execution of the order
1. Mystic Collectibles will take the greatest possible care when receiving and implementing orders.
2. Mystic Collectibles will perform the accepted orders with a as fast processing time as possible.
3. If delivery of an order proves impossible, Mystic Collectibles will send the customer a message and the amount already paid will be refunded to the customer.
4. Mystic Collectibles is authorised to at execution of your orders using third parties.
Article 8 - Payment
1. For each order at Mystic Collectibles, the customer is subject to a payment obligation.
2. You will receive confirmation of your order with the total amount that has to be paid to Mystic Collectibles.
3. The payment methods are only advance payment via bank transfer, online-banking, Paypal or credit card.
4. Payments must be paid within 7 calendar days after receipt of the confirmation email.
If no payment has been received in the aforementioned time period, your order at Mystic Collectibles will be cancelled and you will need to place an order again.
5. Your order will be sent after we receive your payment.
Article 9 - Shipping
1. At Mystic Collectibles all our items are carefully packed and sent.
2. The orders get shipped mostly between 2 and 7 business days with a maximum of 30 calendar days.
3. If delivery is either by (temporarily) are not in stock or is delayed for other reasons, or if an order is not or only partially carried out, the consumer will recieve a message as soon as possible.
4. Once the maximum shipping time of 30 calendar days has been exceeded, let Mystic Collectibles the consumer the choice to maintain or cancel the order.
5. The by Mystic Collectibles specified shipping times are only indicative and depend on several factors.
6. Delayed delivery does not entitle you to compensation.
7. The place of delivery is the home address of the consumer that is known last to Mystic Collectibles, unless a different delivery address is specified with the order.
8. When your order is shipped, you will receive an email with shipping information and a Track-and-Trace number.
9. All orders are delivered via parcel post.
The package need to be signed for delivery, so making delivery to a PO box is not possible.
Article 10 - Shipping Costs
1. Shipping costs will be shown in your shopping cart when placing your order.
2. Shipping costs may vary according to the destination country and apply to standard shipments to the maximum listed weight class.
3. For orders that exceed the default maximum weight class of shipments, there will be individual shipping charges calculated and offered to the customer for approval.
4. Any overall adjustments in the rates for standard shipping only affect confirmed orders placed after the adjustment.
Article 11 - Damaged or incorrect deliveries
1. The risk of damage of goods or incorrect products rests until the time of delivery to Mystic Collectibles, unless otherwise agreed.
2. You have the obligation to examine whether the products meet the agreement and have been delivered undamaged.
3. If this is not the case, you should inform Mystic Collectibles as soon as possible and in any event within 48 hours after delivery, via email to (info@mysticcollectibles.com).
Reported damage after this term is no longer accepted.
4. Only correct reported complaints are accepted by Mystic Collectibles.
Correct reported complaints are sent via email within 48 hours of receipt of your order, in which you stated your personal information, your order reference number and product code of the product.
Hereby add clearly visible digital photos of the product and the flaws.
5. In the absence of data or photos, it is for Mystic Collectibles impossible to determine whether the complaint is justified on the basis of insufficient evidence and the complaint will be not accepted.
6. If it is sufficiently demonstrated that the products do not comply with the agreement or have arrived damaged at the customer, Mystic Collectibles has the choice after recieving back the damaged of incorrect products, to replace the relevant products with new products or to return the payment.
7. Mystic Collectibles is only required to do so, when the complaint within 48 hours after delivery of the order is received by us.
Article 12 - Retention of title
1. The ownership of delivered products shall proceed to you, if you already have fulfilled what you owe to Mystic Collectibles on the basis of any agreement.
2. The risk associated with the products at the time of delivery transfers to the customer.
3. The right to property and the possible risk of loss, is transferred to you upon receipt of the goods, to the delivery address indicated during the ordering process.
When the goods are in your possession, it is your responsibility to treat these with a reasonable care and - in the case of a return shipment - not to use it.
Article 13 - Trial period, right of withdrawal and return
The customer has the right to communicate to the company that he renounces the purchase, without penalty and without giving a reason, within 14 calendar days from the day following the delivery of the good.
1. You have the right, within a period of 14 calendar days to withdraw from the contract without giving any reason.
The term of the revocation shall expire 14 calendar days after the day on which you or a third party designated by you, other than the carrier and the last good is in your physical possession.
2. The consumer may only actually invoke the approval period in the manner indicated by Mystic Collectibles.
Only unused, undamaged and saleable products can only be returned with approval by Mystic Collectibles.
We provide you with instructions for returning your products.
There will be a guiding letter attached with each delivery.
3. Unwanted articles will only be reimbursed if they are returned in their original packaging and are received by Mystic Collectibles in a unused, undamaged and saleable condition.
Articles with a hygiene seal can only be returned if the seal is intact.
Once the seal is broken all right of return expires.
4. The risk and the cost of a return of unwanted orders are for your account.
Mystic Collectibles reserves the right to refuse returned goods, to when these are damaged during transport, due to inadequate packing and/or protection of the products.
We recommend the products sent by registered mail or via parcel post to return it, because Mystic Collectibles cannot be held liable for products that get lost in the mail.
Returns must be postage prepaid, if this is not the case, Mystic Collectibles also refuses to take this to.
5. In order to exercise the right of withdrawal, you must inform Mystic Collectibles through an unequivocal statement (e.g. in writing by post or e-mail) about your decision to withdraw from the contract.
You can use the attached model withdrawal form.
6. In order to comply with the deadline of withdrawal it is sufficient to send your communication regarding your withdrawal before the term of the withdrawal has expired.
7. After we receive your revocation, Mystic Collectibles will send you a confirmation email from receipt and approval with the necessary information to return your order in the correct way to us.
Your package should be returned to an address that at the time of the revocation applies.
The address will be given by Mystic Collectibles with the approval of your withdrawal.
Only shipping to the correct return address will be accepted as valid by Mystic Collectibles.
Packages sent voluntarily to the address of the head office will be refused and returned.
8. You should send the goods without delay, but in any case no later than 14 calendar days after the day on which you make the decision to withdraw from the contract shall be notified to us, returning to us it or to hand over.
You are on time if you return the goods before the period of 14 calendar days has elapsed.
9. If you revoke the agreement, you will receive all the payments you have made up to that point, including delivery costs (excluding any additional costs as a result of your choice for a type of delivery other than the cheapest standard delivery provided by us) after we have received the returned order.
10. We pay you back with the same method of payment as the original transaction has been made, unless you expressly otherwise agreed, at least you will not be charged for such repayment.
11. You are solely liable for any diminished value of the goods resulting from the use of the property, that go beyond what is necessary to the nature, characteristics and functioning of the goods.
Article 14 - Liability
1. For misunderstandings, mutilations, delays or incomplete from order information and notices as a result of the use of internet or any other means of communication between you and Mystic Collectibles, or between Mystic Collectibles and third-party, as they relate to the relationship between you and Mystic Collectibles, Mystic Collectibles is not liable unless there as far as case of intent or gross negligence by Mystic Collectibles.
2. Mystic Collectibles makes great efforts to ensure that the information provided is complete, correct, accurate and up-to-date.
Despite these efforts, errors may occur in the information provided.
If the information provided contains inaccuracies or if certain information on or through the site is unavailable, Mystic Collectibles will make the greatest effort to ensure that this is rectified as soon as possible.
Mystic Collectibles cannot be held liable for direct or indirect damage arising from the use of the information on this site.
If you discover errors in the information provided through the site, please contact the site administrator.
3. The content of the site (including links) may at any time without notice or notification be adapted, modified or supplemented.
4. Mystic Collectibles does not guarantee the proper functioning of the website and cannot be held liable in any way for bad functioning or a temporary (in)availability of the website or for any form of damage, direct or indirect, that may arise from access to or use of the website.

Mystic Collectibles expressly declares that it has no control over the content or other characteristics of these websites en can on no account be held liable for their contents or their characteristics or for any other form of damage as a result of its use.
7. We can not be held liable for any violation, hindrance or delay in the execution of an order that is due to a cause beyond our control by all forms of force majeure, regardless of the fact that the circumstances in question could be provided.
8. Mystic Collectibles shall not be liable if for any reason the website is unavailable for a certain time.
We do not warrant that your access to the website is uninterrupted, timely or error-free.
Due to the nature of the internet, this cannot be guaranteed.
In addition, there is sometimes a need for carrying out repairs, maintenance or the introduction of new capabilities and features.
Article 15 - Force majeure
1. Mystic Collectibles can not be held liable for any violation, intervention or delay in the execution of an order that is due to a cause beyond our control by all forms of force majeure, regardless of the fact that the circumstances in question could be provided.
2. Without prejudice to any other rights due to her in the event of force majeure, Mystic Collectibles has the right to, at its option, to suspend the execution of your order or to dissolve the agreement without judicial intervention, by communicate this to you in writing and without being held to any compensation unless this Mystic Collectibles in the given circumstances according to the standards of reasonableness and fairness would be unacceptable.

2. You should respect fully and unconditionally all intellectual and industrial property rights attached to the products delivered by Mystic Collectibles.
3. Mystic Collectibles does not guarantee that the delivered products do not infringe any (unwritten) intellectual and/or industrial property right of third parties.
Article 17 - Personal data/Privacy statement
1. Mystic Collectibles respects the privacy of its customers and ensures that the personal information you provide is treated confidentially.
This information is only used for the purpose of executing an order as smoothly and easily as possible.
2. For all the rest, such as sending the newsletter, we will only use your personal information with your consent.
3. Mystic Collectibles will not sell your personal data to third parties and will only provide access to that information to them when they are involved in the execution of your orders (for example to our courier or supplier).
Article 18 - Newsletter
1. Mystic Collectibles will keep you informed via the newsletter of all promotions, new products, competitions and any changes to the website.
2. The frequency of sending varies from 1 mailing per month up to a maximum of 2 mailings per week.
3. You can always activate the newsletter or deactivate it as desired.
Article 19 - Reviews
1. On the website you can read the reviews and give feedback on the delivered products.
2. Mystic Collectibles has the right to remove unsubstantiated or unfounded negative reviews.
Likewise the use of offensive language, unclear formulated texts, commercial messages (or positive mention or prices of other directly or indirectly competing companies), offensive contributions and business that are in conflict with the law and/or third party rights, will be removed.
Article 20 - Governing law and disputes
1. If one or more of the provisions of these terms and conditions or any other agreement with Mystic Collectibles is in conflict with any applicable regulation, the relevant provision will lapse and will be replaced by Mystic Collectibles with a new to establish similar provision.
2. These general terms and conditions and the use of the website are governed by and construed in accordance with Belgian law.
3. All disputes who can not be resolved amicably between parties related to these terms and conditions, are subject to the exclusive jurisdiction of a Belgian Court in Bruges.
